Reply Brief Filed in NAACP Colorado v. USEIP

Right this moment, Free Speech For Individuals and co-counsel Bryan Sells filed a reply transient on behalf of Colorado Montana Wyoming State Space Convention of the NAACP (NAACP Colorado), League of Girls Voters of Colorado (LWV Colorado), and Mi Familia Vota (MFV) in NAACP Colorado v. USEIP. This attraction challenges the dismissal of a lawsuit towards the USA Election Integrity Plan (USEIP) and three of its leaders who orchestrated a door-to-door marketing campaign to intimidate Colorado voters of their properties.

Within the months following the 2020 election, USEIP brokers went to voters’ properties to query them about their methodology of voting, interrogate them about so-called fraudulent ballots, levy baseless accusations of fraud, and take images of their properties. USEIP inspired armed members to affix the marketing campaign, and reported purported findings to native prosecutors. USEIP leaders orchestrated, recruited for, and publicized the marketing campaign, with one chief publicly calling for anybody who commits election fraud to be hung. However the district courtroom dominated that not one of the defendants have been responsible for intimidation.

Free Speech For Individuals filed a gap transient within the attraction in November. The US Division of Justice additionally filed an amicus transient in assist of NAACP Colorado, LWV Colorado, and MFV’s attraction. The reply transient now solutions the defendants’ briefs, correcting the factual report and the defendants’ flawed authorized assertions. The plaintiffs clarify that the defendants’ transient—regardless of making advert hominem assaults on the plaintiffs—“do nothing to rehabilitate the district courtroom’s judgment, which rests on error after error.”

Because the transient argues, “Congress adopted the Voting Rights Act and the Ku Klux Klan Act to safeguard our democracy at crucial junctures in our nation’s historical past. The district courtroom’s rulings . . . weakened these protections, they usually have undermined accountability.” The plaintiffs ask that these severe errors be reversed as a way to defend the voters of Colorado.
