Within the Gun Free Faculty Zone case towards Gabriel Metcalf in Billings, Montana, the authorities have returned Gabriel’s single-shot 20-gauge shotgun, an ammunition pouch, and the six rounds of 20-gauge ammunition that have been seized when Gabriel was arrested on August 23, 2023.

The Ninth Circuit Courtroom of Appeals dominated the case illegitimate and remanded it to the District Courtroom with directions to dismiss. The Ninth Circuit opinion was despatched to the District Courtroom on September 23, 2025, simply wanting two years after Gabe was arrested.

AmmoLand has been on the forefront of reporting on this case, with over two dozen articles over the course of the final two and a half years.

Officer Stroble returned Gabe’s shotgun, ammunition, and ammo pouch. He doesn’t seem completely happy or pleasant. Picture courtesy of Gabe Metcalf and Mom.

It’s not clear if the officers have been performing on behalf of the Billings Police Power or the ATF/Billings Police Job Power. Gabe says Officer Stroble was the officer who arrested him two and a half years in the past as an officer within the activity drive. The arrest was a federal arrest primarily based on the federal Gun Free Faculty Zone Act.  The duty drive was used to arrest Gabe after the Billings police, on an area TV station, stated they might not arrest Gabe as a result of he was not breaking the legislation.

Gabriel gained his case within the Federal Courts. The Ninth Circuit didn’t say the Gun Free Faculty Zone legislation was unconstitutional. They stated Gabe ought to by no means have been indicted and tried.

Gabe and his mom, Vivian, suffered important damages through the two and a half years of punishment by course of within the courts. Gabe spent a month in jail and years on probation. His mom stopped her enterprise as a seamstress. Their budding recycling enterprise was destroyed. Their status was broken, relationships destroyed. Once I spoke with Gabe and his mom, I realized that Gabe’s property, notably the shotgun, had not been returned months after the case was dismissed.

It has been frequent for police departments to fail to return property, even to those that win within the courts. Forcing the police to conform usually prices greater than the property is price. My suggestion to Gabe and his mom was that they contact Gary Marbut for recommendation.

Gary Marbut is the founder and President of the Montana Taking pictures Sports activities Affiliation MSSA. He’s a legendary determine in Montana’s Second Modification group.

Gary put ahead the concept of sending a letter from the MSSA to a candidate for the US Senate in Montana, Kurt Alme. Kurt Alme was the USA Legal professional for Montana, appointed by President Trump. Alme resigned from the US Legal professional’s workplace on March 6, 2026. Gary despatched the letter on March 10, 2026.

Kurt Alme’s predecessor had been appointed by President Biden. Kurt has good contacts within the US Legal professional’s workplace in Montana. Timothy J. Racicot is at the moment the performing United States Legal professional in Montana.  U.S. Legal professional Racicot was the performing U.S. Legal professional assigned to the place by President Trump earlier than Kurt Alme was appointed because the U.S. Legal professional in Montana in 2025.

Racicot was the First Assistant U.S. Legal professional through the earlier administration, earlier than changing into performing U.S. Legal professional. Kurt Alme was Racicot’s boss for 5 months, from October 7, 2025 to March 6. 2026. The Ninth Circuit ordered the District Courtroom to dismiss the case on September 23, about two weeks earlier than Kurt Alme was appointed to be the USA Legal professional for Montana, and have become Timothy J. Racicot’s boss.

Kurt Alme was not in cost when the Metcalf Gun Free Faculty Zone case was being prosecuted. It could be Kurt Alme was unfamiliar with the case, because it was ordered dismissed earlier than he was appointed.

On March 10, Gary Marbut despatched Kurt Alme a letter to remind him of the case. On March 20, 2026,  Gabe’s shotgun was returned by Officer Strobel. Stroble is alleged to be the identical officer who had arrested Gabe. Gabe and his mom obtained a telephone name on or about March twentieth, which was tough to determine. When known as again, the officer on the telephone wished Gabe to come back to their workplace to choose up the shotgun.

Gabe insisted his shotgun be returned to the place it had been seized.

Inside half an hour, on March twentieth, at about 0930, the shotgun was returned. Such a fast response makes it seem the return was thought of a excessive precedence.

Due to the character and excessive profile of the case, and since Kurt Alme had already resigned as United States Legal professional earlier than the letter from Gary Marbut was despatched, there isn’t any documented proof that the letter was liable for the shotgun being returned. The timeline implies that such will be the case.

Gabe’s mom, Vivian, reminded the officers who have been returning the shotgun, the entrance door didn’t work correctly. In accordance with Gabe’s mom, it was unnecessarily broken when the officers served a warrant on August 23, 2023, the day Gabe was peaceably arrested outdoors his house.

Gabe was arrested when he went to speak to officers at a car parking zone throughout the road outdoors his house. Gabe stated he took the initiative to speak to them. He had the understanding the state of affairs could be resolved in his favor. Gabe stated he had left the shotgun inside, as he had stated he would do, to the identical officers, days earlier.

The arrest, indictment, trial, enchantment, and dismissal have been all uncalled for.

It’s unknown if Gabe and his mom will ever be made entire for his or her years of struggling and punishment by the method.

Gabe’s Mom, Vivian, has established a GiveSendGo web site.
