What standards should residents looking for related aid want to fulfill to show themselves eligible for equal remedy? (img Duncan Johnson)

“That is an interim response to the Freedom of Data Act (FOIA) request of your shopper, David Codrea, dated and obtained on this Workplace on April 28, 2025, for data in regards to the restoration of firearm rights to particular people,” a Thursday letter to legal professional Stephen Stamboulieh from Vanessa R. Brinkmann, Senior Counsel, U.S. Division of Justice Workplace of Data Coverage begins.

My request was submitted after the DOJ introduced it had “recognized ten (10) people for firearm restoration [actor Mel Gibson among them].” Left unaddressed was what standards residents looking for related aid would wish to fulfill to be thought of for equal remedy. To that finish, I filed a FOIA request asking for:

All data “reviewed” by the Lawyer Normal for every particular person listed within the submitting;

All data “that every particular person submitted” to obtain aid beneath 18 U.S.C. 925(c); and

All different data not “submitted” by the checklist of people however relied upon by the Lawyer Normal in establishing that “every particular person is not going to be more likely to act in a way harmful to public security and that the granting of the aid to every particular person wouldn’t be opposite to the general public curiosity.”

As a result of the federal government didn’t reply to the request within the time required by legislation, a criticism was filed in the USA District Court docket within the District of Columbia asking the court docket to order DOJ to conduct a responsive search, produce non-exempt data “by a date sure,” enjoin DOJ from persevering with to withhold data, and award legal professional charges/litigation prices that might not have been wanted had it merely complied with settled legislation.

“No response is required…  Plaintiff shouldn’t be entitled to compel the manufacturing of any report… This Court docket lacks material jurisdiction… Plaintiff is neither eligible for nor entitled to legal professional’s charges [and] Plaintiff’s request is improper to the extent is it unduly burdensome,” US Lawyer Jeanine Ferris Pirro and Assistant US Lawyer John J. Pardo argued again within the Division of Justice’s reply, filed Dec. 19.

Regardless of that customary authorized response, Thursday’s interim response, together with a Memorandum for the Lawyer Normal on “Candidates for Aid from Firearms Incapacity,” suggested “{that a} search has been carried out and materials aware of your request has been situated. Presently, I’ve decided that 5 pages are acceptable for launch with sure data withheld pursuant to Exemptions 5 and 6 of the FOIA… and copies are enclosed.”

Citing “inter- and intra-agency communications protected by civil discovery privileges,” and  “data the discharge of which might represent a clearly unwarranted invasion of private privateness,” the memorandum is closely redacted, to the place all that’s included pertaining to the candidates is their names, not the factors used to find out their eligibility (outdoors of U.S. Code citations noting the Lawyer Normal is empowered to grant aid to these decided “’not… more likely to act in a way harmful to public security and’ the place ‘the grating of aid wouldn’t be opposite to the general public curiosity.’”)

The FOIA request by no means requested for something that was not a matter of nonexempt report, and the intent behind the hassle was merely to find out what standards residents looking for related aid would wish to fulfill to show themselves eligible for equal remedy.

As a result of that is an “interim response,” extra paperwork must be coming. We’ll have to attend to see what they disclose.
