NSSF issued a press release at present, declaring their disappointment with the U.S. Supreme Courtroom’s denial of a writ of certiorari in Barnett v. Raoul, one in every of a number of challenges to Illinois’ bans on Trendy Sporting Rifles (MSRs) and standard-capacity magazines. The choice to not overview the U.S. Courtroom of Appeals for the Seventh Circuit’s choice at this early stage of the litigation, whereas disappointing, doesn’t imply the Supreme Courtroom won’t overview the matter later after remaining judgment.

The Supreme Courtroom denied overview now as a result of the U.S. Courtroom of Appeals has not but issued a remaining judgment. Justice Samuel Alito, nonetheless, would have granted the petition now. Justice Clarence Thomas wrote, “This Courtroom is rightly cautious of taking circumstances in an interlocutory posture. However, I hope we are going to contemplate the necessary difficulty offered by these petitions after the circumstances attain remaining judgment.”

Justice Thomas concluded Illinois’ bans are “extremely suspect,” discovering it “troublesome to see how the Seventh Circuit might have concluded that essentially the most broadly owned semiautomatic rifles are usually not ‘Arms’ protected by the Second Modification.” He added, “However, if the Seventh Circuit in the end permits Illinois to ban America’s most typical civilian rifle, we will—and may—overview that call as soon as the circumstances attain a remaining judgment. The Courtroom should not allow ‘the Seventh Circuit [to] relegat[e] the Second Modification to a second-class proper.’”

“We’re disenchanted the U.S. Supreme Courtroom selected to not settle for this problem presently to what’s clearly an unconstitutional regulation,” stated Lawrence G. Keane, NSSF Senior Vice President and Basic Counsel. “The Trendy Sporting Rifle – or AR-15-style rifle – is essentially the most popular-selling centerfire rifle in America, used for lawful functions daily. That features leisure goal taking pictures, searching and self-defense. These rifles are clearly ‘Arms’ which can be protected by the Second Modification for law-abiding residents to maintain and bear.”

There are over 28.1 million MSRs in circulation at present, greater than there are Ford F-150s on the street at present – essentially the most popular-selling pick-up truck in America.

The problem to Illinois’ ban on MSRs and standard-capacity magazines, Barnett v. Raoul, will now proceed to trial later this 12 months within the U.S. District Courtroom for the Southern District of Illinois.
