Supreme Court Should Hear Challenge on SBR Restrictions

The Second Modification Basis (SAF) has filed an amicus transient urging the Supreme Courtroom to listen to David Robinson Jr. v. United States, a case difficult federal restrictions on short-barreled rifles (SBRs).

Becoming a member of SAF within the submitting are the Second Modification Legislation Middle, the California Rifle & Pistol Affiliation, and the Minnesota Gun House owners Caucus.

Why This Issues

The Eleventh Circuit Courtroom of Appeals relied on U.S. v. Miller (1939) to uphold SBR restrictions, arguing they’d no militia use—just like its earlier stance on short-barreled shotguns. SAF says that logic doesn’t maintain up.

“Even when Miller have been the proper customary, SBRs are in common army use at the moment,” stated SAF Director of Authorized Analysis and Training Kostas Moros.

“The M4 rifle, our army’s customary subject, has a 14.5-inch barrel—beneath the 16-inch restrict set by the regulation,” he continued. “Many variants, just like the MK18, are even shorter. Miller really helps our place, not the federal government’s.”

The Transient’s Key Factors

SBRs qualify as “arms” underneath the Second Modification.

The federal government bears the burden to show a historic custom of regulating firearms primarily based on barrel size—and no such custom exists.

Right now’s customary army rifles fall underneath the “short-barrel” class focused by the regulation.

SAF says the case is larger than only one regulation—it’s about correcting courts that misapply the Second Modification.

“This amicus transient is only one a part of our struggle towards the Nationwide Firearms Act’s restrictions on SBRs and silencers,” stated SAF founder Alan M. Gottlieb.

The Supreme Courtroom has not but determined whether or not to listen to the case.
